HTC EVO 3D Gets The Android 4.0 ICS Update In India

Last year, HTC launched its first 3D smartphone, the HTC EVO 3D. This handset allows you to record 2D videos in full HD (1080p) and 3D videos in HD (720p), thanks to its 5 megapixel dual cameras. HTC EVO 3D was shipped with the Android 2.3 (Gingerbread) Operating System. Back in March, HTC has promised to roll out the Android 4.0 (Ice Cream Sandwich) update for 16 smartphones, including the HTC EVO 3D.

HTC has already rolled out the Android 4.0 update in the Europe, Middle East and Africa region. However, the EVO 3D owners in India were still waiting to get their hands on the Android 4.0 OS. Now, we have good news for the folks in India. HTC India recently tweeted that the company has started rolling out the much-awaited Android 4.0 (Ice Cream Sandwich) update for this unique smartphone in India.

The latest update brings the Sense 3.6 UI, system bar enhancements, lock screen actions including pull down notifications and adjust volume while device is locked, re-sizeable widgets, data usage controls, advanced voice and text input, improved menu structure, face unlock, home screen folders, improved battery life, improved text input and spell checking and much more.

The size of the update is 300 MB and it bumps the HTC EVO 3D to 4.0.4 (Ice Cream Sandwich) OS. This update will be available via OTA (Over-The-Air). You will be automatically notified when the update is available for your device. If you have not received the update, then just go to Home > Applications > Settings > About Device > System updates and check for the update. (AP) ? A strong explosion rocked the Syrian capital Thursday near a busy market and the country's highest court, wounding at least three people and sending clouds of black smoke into the sky.

The blast came as tensions threatened to spread across the region. Neighboring Turkey deployed anti-aircraft guns and other weapons alongside its border with Syria, nearly a week after Syrian forces shot a Turkish military plane out of the sky, Turkish state TV said Thursday.

Major world powers will meet Saturday in Geneva for talks on Syria, but few observers expect a major breakthrough. Syria has the protection or Russia, a veto-wielding member of the U.N. Security Council, and has so far been impervious to international pressure.

Russian Foreign Minister Sergey Lavrov said Thursday that Moscow will not endorse a call for Assad to give up power.

"We are not supporting and will not support any external meddling," he said. "External players must not dictate ... to Syrians, but, first of all, must commit to influencing all the sides in Syria to stop the violence."

It was not clear who was behind Thursday's blast in Damascus.

Much of the violence that has gripped Syria since the uprising began has been sanctioned by the government to crush dissent. But rebel fighters are launching increasingly deadly attacks on regime targets, and several massive suicide attacks this year suggest al-Qaida or other extremists are joining the fray.

An Associated Press reporter at the scene of the blast said some cars were charred and many had their windshields blown out.

"I did not see any wounded people, but cars and nearby shops were damaged," said Fawaz Mishhim, a witness who was in a nearby market when he heard the explosion.

Syria's state-run TV said the explosion was in the parking lot of the Palace of Justice, a compound that houses several courts. The blast happened at 1 p.m. near the capital's famous Hamidiyeh Market, an area crowded with families stocking up on food and other supplies for the weekend, which begins on Friday in Syria.

Witnesses reported hearing one blast, but state-run TV said two explosions struck the area. The report also said a roadside bomb was found but did not explode.

Syria has been hit by a wave of massive explosions in recent months, killing dozens of people. Most of the explosions targeted the security agencies of President Bashar Assad, who is fighting to end a 15-month-old uprising against his rule.

Last month, an explosion targeted a military intelligence compound south of Damascus killing 55 people. It was Syria's deadliest blast.

Elsewhere in Syria, activists reported clashes between troops and rebels and said more than a dozen people were killed nationwide. Some of the heaviest battles were in the eastern city of Deir el-Zour, activists said.

Activists say more than 14,000 people have been killed since the Syrian uprising began in March 2011.

Turkey, a former ally, has become one of the strongest critics of the Assad regime. Tensions between the two countries spiked following the downing of the Turkish plane last week.

Syria insists the Turkish military plane violated its air space on Friday. Turkey says the jet had unintentionally strayed into Syria's air space and was inside international airspace when it was brought down over the Mediterranean by Syria.

The search for two missing pilots continued in Syrian waters but hopes for their survival are dim, Turkish authorities said. The Turkish military said Thursday that research teams have found some pieces of the plane as well as equipment belonging to the pilots.

A small convoy of military trucks towing anti-aircraft guns entered a military outpost in the border village of Guvecci, which faces a Syrian military outpost, according to TRT television footage.

Several anti-aircraft guns also have been deployed elsewhere alongside the border. Some trucks were seen carrying self-propelled multiple rocket launchers, the footage showed.

Ties between Turkey and Syria have not been so low since the late 1990s, when the two countries almost went to war. Tensions ran high in the 1980s and 1990s as Turkey developed military ties with Israel and Syria sheltered Turkish Kurd guerrilla leader Abdullah Ocalan.

Now, Turkey is hosting civilian opposition groups as well as hundreds of army defectors who are affiliated with the rebel Free Syrian Army.

Turkish President Abdullah Gul was holding a National Security Council meeting on Thursday, TRT said. The meeting, attended by Cabinet members and the military's top brass, is expected to focus on tensions with Syria.

Katelyn Mullen: 'So You Think You Can Dance' Recap: Top 20 Dancers Revealed In Season 9, Episode 6

This week's comments, questions and concerns come without any technical dance knowledge and no actual dance skills ... just straight up love for "So You Think You Can Dance."

It's the 200th episode of "SYTYCD," the first live episode of the season, Zooey Deschanel is the guest judge and the BIG reveal of the Top 20. I am one pinata away from a party over here.

Thankfully this year, producers didn't drag out the big reveals and bring the camera crews and judges to the houses of the hopefuls just to crush their dreams in front of friends, family and millions of Americans. They kept the reveals brief and gave us practically no surprises, which wasn't actually so bad. Perhaps they're saving the shocks for some later episodes.

The judges do, however, get me every single time they bring two dancers in and act like only one is in. Every. Single. Time. Mary Murphy really had me with best friend ballroom dancers Witney and Lindsay. (Spoiler alert: they both make it.)

The most pleasant of all surprises so far this season, they didn't tap dance all over our hearts by bringing Cyrus to the finals and then drop him before the Top 20. Nigel said they were taking a big chance by including Cyrus, but I think the biggest chance "SYTYCD" has ever taken may just be asking Zooey Deschanel to be a guest judge (seriously, I love her, but she brought nothing to the proverbial judges table). Maybe it was the excitement of the first live performances of the season or maybe it was just the fan blowing on me in my apartment, but I was covered in goosebumps, head-to-toe, for these performances. Some highlights ...

This dance was just so beautiful. Travis Wall, you magnificent little genius, you. The girls were so graceful, but I couldn't help but think about how absurdly strong these ladies are, like incredible hulk strong. I'd just like to say the door from Katee & Twitch's "Mercy" routine made its triumphant return (I still love that damn dance so much) and perhaps I am getting a little crazy here, but let's call this a little foreshadowing for what's to come. I think I might actually like anything and everything Sonya's ever done and will do. I said it, Nigel said it, my watching pal TV editor Jaimie said it, too: The pants! What is with the pants?! Maternity, genie or otherwise, they were distracting! But seriously, if their pants are the only thing I can complain about then why even complain, right?

Twitter Reactions To Supreme Court Health Care Ruling

The Supreme Court upheld the part of the Affordable Care Act that requires individual insurance -- known as the individual mandate -- on Tuesday morning.

The controlling opinion, written by Chief Justice John Roberts, upheld the mandate as a tax, although concluded it was not valid as an exercise of Congress' commerce clause power. Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan joined in the outcome.

I can?t tell you how many times I?ve been asked out to some fattening restaurant, and instead of worrying about what to wear, I was busy worrying about what I was ?allowed? to eat. It?s normal to obsess about the details?like how to seem like a cool girl who eats without looking like a cow, or how to stick to your diet but avoid being one of those ?salad-eating girls? who orders everything on the side. But they don?t have to take over your dating life. Your goal should be to strike a balance: Enjoy the meal, and still feel good about your choices afterward. Here?s what I tell myself, and my clients, before a big night out on the town. Pick the place If your date asks you to suggest a place to eat, check out menus online first so you can scout out the healthier options. Sushi , Mediterranean , and Spanish tapas places are typically full of healthy, delightful, and well-portioned fare?while sports bars, ethnic cuisine, and heavy French food might make it more difficult to find the best choices. Ambiance matters too: Research has shown that eating outdoors or in lots of bright lights can help you eat less, perhaps because you?re paying more attention to your date and the pleasant surroundings. If you get stuck in a total fattening zone?a Super Bowl party or an all-you-can-eat buffet, for example?then try everything but don?t fill your plate with any one thing. Snack first Spoiling your appetite just a little bit is a good thing: You will most likely be going to a restaurant with lots of fattening choices, starting with a tempting bread basket. But if you eat a 200-calorie, high-protein snack ?such as edamame, whole-grain pita with hummus, a packaged veggie burger, or a handful of nuts?right before leaving the house (or at most, no more than three to four hours earlier), you should be able to tear off just a small chunk of bread, dip it in some heart-healthy olive oil, and push the rest aside. Snacking beforehand will also keep you from drinking on an empty stomach, which can lower your inhibitions about food and leave you ravenous. Drink in moderation If you decide to have a drink or two (no more than that, though!), choose a clear-liquor cocktail like a vodka tonic or my SkinnyGirl Margarita ?clear tequila on the rocks with lime and a splash of citrus liqueur. Typically, darker liquor has a higher sugar content; plus, many people say they trigger worse hangovers the next day, provoking greasy eating binges. Wine is a good choice too, because of its antioxidants and health benefits . But you may tend to drink wine faster than liquor, and it?s important to remember that each glass contains about 100 calories, depending on the grape: Dry white wine, for example, is slightly lower-cal than sweeter Chardonnay. The most important thing to remember about drinking on a date (or anywhere, for that matter), is to drink water too: Have a full glass before, during, and in between each of your cocktails. It will help you feel fuller faster, and prevent overeating (and overdrinking) while helping to negate the dehydrating effects of alcohol. Order an appetizer Appetizers scare most people who are watching their weight, but to me, they?re like a gift: Most are already portioned for you (skip the sampler plate!), so overindulging is kept to a minimum. Still, it doesn?t hurt to order something with a vegetable base, like a mixed greens salad or a non-cream soup. Skip?or share?the entree Restaurant entrees are way too large in this country: It?s a fact that if you eat out more often, you?ll gain weight?unless you bundle up your leftovers or make smarter food choices. I can usually get around this predicament, however, by ordering a second decadent appetizer instead of an entree. At most restaurants, you?ll be able to choose small, single-serving plates such as crab cakes, grilled calamari, mini?burgers, or chicken sate. To turn your appetizer into a satisfying meal, order a side dish?or two if you?re sharing with your date. One should be green and healthy (sauteed spinach or broccoli rabe), and one more indulgent. If your date really wants fries, for example, have a few, but leave them on his side of the table. Here?s where you can practice my mantra: ?Taste everything, eat nothing.? GOP lawmaker loses in Okla., Hatch wins in Utah

(AP) ? Republican divisions resurfaced in congressional primaries, with five-term Rep. John Sullivan falling to a tea party backed opponent in Oklahoma while Utah Sen. Orrin Hatch easily defeated another candidate backed by the insurgent group. It was Hatch's first primary challenge since his election to the Senate in 1976.

Jim Bridenstine, a Navy pilot and the former director of a Tulsa space museum, defeated Sullivan on Tuesday, making him the fourth incumbent congressman to lose in primaries this year. Bridenstine labeled Sullivan a career politician and criticized his votes to rescue financial firms during the height of the 2008 economic meltdown and to increase the debt ceiling last year.

Sullivan seemed to be caught off guard by the closeness of the race. He had won his five previous elections with an increasingly larger percentage of the vote.

Hatch, 78, had been bracing for a tough re-election battle, but he breezed to victory. Former state Sen. Dan Liljenquist, who survived a 2008 plane crash in Guatemala that killed 11 of 14 on board, won just enough support at the state GOP's nominating convention to advance to the primary.

But Liljenquist faced an overwhelming financial and organizational disadvantage in the contest. Hatch, learning from the defeat two years ago of his Senate colleague Robert Bennett, spent about $10 million blanketing the airwaves and building a campaign operation unlike anything Utah had seen before.

Hatch told The Associated Press in an interview Tuesday night that he was ready to tackle the nation's debt problems and focus on Social Security and Medicare.

"This is my last term," Hatch said. "I'm ready to bite the bullet."

In a third high-profile race, 82-year-old New York Rep. Charlie Rangel won his Democratic primary in spite of a House censure 18 months ago for failing to pay all his taxes and for filing misleading financial disclosure statements. Final but incomplete Election Day returns gave Rangel a narrow 2.8 percentage point margin over state Sen. Adriano Espaillat, a native of the Dominican Republic. An unknown number of absentee ballots, plus returns from 33 of the district's 506 precincts, remain to be counted before the final vote is certified next month.

During the Oklahoma GOP campaign, Bridenstine said Sullivan's history of "substance abuse" made him unfit for office, a reference to Sullivan's battle with alcoholism that involved a one-month stay at the Betty Ford Clinic in California in 2009.

In a series of advertisements and at debates, Bridenstine noted that Sullivan had missed 9 percent of House votes since 2003, much higher than the average rate of 2.4 percent. Sullivan said Bridenstine was making a read-between-the-lines attack on his time at the Betty Ford Center and his missing votes after the death of a child.

Bridenstine, 36, enjoyed the support from many in the tea party movement. He said during the campaign that Sullivan's votes weren't appropriate in a state where President Barack Obama failed to win a single county in 2008.

"He's been there for 10 years and there's a lot of people just like him who have made a career out of this, and when you are a career politician, you vote for things like bailouts, debt ceiling increases, government takeovers, stimulus packages and subsidies," Bridenstine said.

In Hatch's quest for a seventh term, he seemed to have an answer to every criticism. For those who said that 36 years in office was enough, he said that he wouldn't be running again if it weren't for the opportunity to serve as chairman of the Senate Finance Committee if the GOP wins control of the Senate.

For those who said he wasn't conservative enough, he gravitated to the right, scoring a 100 percent rating from the American Conservative Union in 2010 and 2011. His lifetime rating of 89 percent from the ACU would place Hatch among the Senate's most conservative lawmakers.

Liljenquist, 37, a relative newcomer to the Utah political scene, seized on voters' concerns about the growing national debt and tried to make the case that Hatch had been a major contributor to that debt.

A political action committee called FreedomWorks for America spent about $900,000 trying to defeat Hatch. Russ Walker, national political director for the super PAC, said his organization believes it did the right thing by taking on the incumbent. He noted that Hatch's voting record and rhetoric had become more conservative over the past two years.

With the primary victory, Hatch is a huge favorite to win the general election in November against Democratic candidate Scott Howell.

Alabama temple rebuilds after head monk's murder

ST. ELMO, Ala. ? Vern Phdsamay, a Buddhist monk, sits quietly not in his temple along Alabama's Gulf Coast but in a Mobile County jail cell. He's charged with murder, accused of having beaten the temple's chief monk to death last month before calmly washing up and eating dinner.

Once again, the peace at Wat Buddharaksa Temple has been shattered.

In 2008, a fire that was ruled an accident destroyed the temple. It took two years to rebuild.

In 2010, the BP oil spill devastated the economy of the local Laotian and Thai communities served by the temple.

Now it is without its spiritual leader of a dozen years. Prosecutors say Chaiwat Moleechate, 45 ? the head monk, who led the work to rebuild the temple ? was bludgeoned to death during an argument May 11.


Phdsamay, 32, was quickly arrested and charged with murder. At his bond hearing last month, Assistant District Attorney Jo Beth Murphree said Phdsamay smashed Moleechate on the head at least 12 times with a foot-long wooden pestle. Then, "He went back to his living quarters, showered and washed his clothes, and he went back and ate," she said.

Phdsamay (pronounced PIT-suh-my) was bound over to a grand jury Monday. Penniless because he has sworn a vow of poverty, his lawyer says, he remains in Mobile County Metro Jail on $50,000 bond.

It's not clear exactly when Phdsamay, who speaks no English, joined Wat Buddharaksa. Authorities say he is a legal resident of the U.S., having immigrated from Laos and settled in the area in 2005.

What is clear is that for at least the last three months, Phdsamay had been troubled. He stopped talking and refused to join his fellow monks for meals, and Moleechate (pronounced MOLE-uh-shayt) had been trying to help him, temple members said.

A doctor was brought in to see Phdsamay, but he refused to take any medicine, temple members said. That was when Moleechate began making plans to send him off the grounds for treatment, said Bouasanouuong, a member of the temple's governing committee who, as is customary in some Thai communities, uses one name.

For some time, she said, it seemed that Phdsamay had been "kind of a little bit mental." But no one thought he might be capable of murder.

On May 11, a Friday, Phdsamay and Moleechate had an argument, and at some point Phdsamay's meal was thrown away, prosecutors said. Witnesses said Phdsamay began beating Moleechate with a long stick, later identified as the foot-long wooden pestle.

Chaiwat ended up dead, and Phdsamay ? whose jailhouse booking photo shows him with long, red scratch on his neck ? ended up in custody on murder charges.

Neil Handley, Phdsamay's attorney, said his client claimed that he got the scratch defending himself from Chaiwat, who he said "came at him" first.

That doesn't square with how temple members remember Reverend Chaiwat, as he was known.

Moleechate was "a very kind person," temple member Steve Chatahuane said. "He helped everyone that needs help."

"Sometimes I ask myself, do good people always go first?" Chatahuane said. "He was one of the good people that I knew."

On July 15, Johnson & Johnson announced that two of its operating companies had filed supplementary applications with the U.S. Food & Drug Administration (FDA) and with the European Medicines Agency (EMEA)?seeking approval for?the?company to market abiraterone acetate (Zytiga) ? in combination with prednisone or prednisolone ? for the treatment of men with asymptomatic or mildly sympromatic, chemotherapy-naive, metastatic, castration-resistant prostate cancer, based on the results of the so-called ?302 trial? ??data from which was recently presented at the annual meeting of ASCO.

Assuming that these applications are ?clean? and do not raise major questions for either the FDA or EMEA, one could reasonably expect to see approvals of abiraterone acetate for these indications in the USA and in Europe by the end of 2012. However, such approvals may take longer if either regulatory agency expresses concerns about the quality of the applications. As we have mentioned in prior commentary, there?is the potential for such concerns on the part of the regulatory agencies.

Denver officer shot, killed near park concert

(AP) ? A Denver police officer trying to break up a confrontation was shot and killed at a city park where families had gathered for a free weekly jazz concert before gunfire erupted and sent hundreds running.

The officer, who was shot in the head Sunday, was taken to a hospital where she was pronounced dead, police spokesman Sonny Jackson said. Police were searching for a suspect in what Jackson described as an isolated incident.

At least three shots were fired shortly after the jazz band playing on a lake-side pavilion stage finished, sending waves of people running through park grounds where some concert goers who were initially unaware of the shooting remained seated on picnic blankets and lawn chairs.

More than 1,000 people were at the City Park Jazz concert, the fourth of 10 shows scheduled for this summer in the annual series that draws families and people of all backgrounds to one of the city's more popular summer events. The mayor said late Sunday that the concerts should continue.

"We will not surrender what we consider special in this city to anyone," Denver Mayor Michael Hancock said.

Nakira Doss, a jazz singer herself, said she hopes the series continues. The 28-year-old mother was at the show Sunday and sitting near the stage with her children, ages 4, 5 and 7, when she heard at least two shots. As people ran past, she said told her children to "get on the ground" and then she laid herself over them.

"I'm trying to show them music, but at what cost," she said, nodding toward her own children.

City Park is one Denver's most famous and sprawls across several hundred acres east of downtown. It holds the Denver Zoo, Museum of Nature and Science, as well as ponds, trails and recreational fields.

After shots rang out, scores of people ran from the northwest side of the pond and stage area, confusing crowds on the south side of the pond who were still lingering over conversation and picnics in lawn chairs and blankets. Someone announced from a loudspeaker on stage that the park was closed and told park goers to leave from the south side.

Nakira Doss, 28, was sitting near the stage when she heard at least two shots. She said she covered her three children, ages 7, 5 and 4, as other concertgoers ran past.

Samuel Bell, 19, of Denver, said he was in the parking lot looking for a space for his scooter, which police later cordoned off with yellow tape. He said he heard several shots.

"We just arrived at the park. It was crowded, it was looking fun," Bell said. "And then 'pa- pa-pa-pa' outta nowhere.

"We just ducked," Bell said. "We pulled off in enough time to get away. It was crazy."

He said he saw police officers administering CPR. He estimated he was about 10 to 20 feet away from where the officer was shot.

Bob Cashell: Super-Bowl Comes to Reno

When people think of Nevada, often times the first thing that comes to mind is Las Vegas -- and for good reason. It's the Entertainment Capital of the World and home to the best casinos, restaurants and hotels that you'll find anywhere. But Nevada is a land of many incredible treasures and among them is the great city of Reno, the "Biggest Little City in the World."

Later this month, Bowling's U.S. Women's Open will come to Reno, bringing together two of our country's great treasures -- and two classic American comeback stories.

I see a fascinating parallel between Reno and bowling. Bowling is a sport that some thought had seen its heyday. After explosive growth during the 1950s and 60s, the bowling industry cooled off during the late 1980s and early 90s and some thought that it was a pastime whose time had passed. Boy were they wrong. In recent years, bowling has seen an incredible resurgence, fueled by the emergence of entertainment bowling centers that offer a more upscale experience including lounge areas and restaurant quality food. Bowling is now the nation's number one participatory sport with more than 71 million people taking to the lanes annually (more than 832 million games played every year) and the sport is seeing surging popularity among female and youth audiences. In fact, bowling now competes with hockey as one of the nation's fastest growing high school sports.

Similarly, the city of Reno is an incredible turnaround story. Reno had a series of ups and downs in the early 20th century and after gas explosions rocked the city in the late 1950s, Reno went through some tough times. However, years of hard work and investment have paid off and today Reno is flourishing. With a population of more than 225,000, Reno is the largest city in Northern Nevada and home to a growing economy and rapidly developing cultural center. There is now just so much going on in Reno... the River Walk District, Nevada Museum of Art, the Triple A Reno Aces, the Reno Championship Air Races... not to mention breathtaking views of the majestic Sierra Nevada mountains and easy access to Lake Tahoe, one of the most gorgeous places on the planet.

In just a few short weeks, the finals of the Bowling's U.S. Women's Open will be played underneath the iconic Reno arch on Virginia Street nearby the Eldorado Hotel Casino. It will be an incredible outdoor sports experience that will break new ground for bowling. More than 300 competitors from over 16 countries will compete with a chance to win a million dollars if a perfect 300 is rolled in the finalist competition, which will be aired on ESPN2.

I'll be candid -- bowling is good business. The economic benefit of hosting the U.S. Women's Open in Reno is significant. It's estimated that the event will bring several thousand tourists to the area and create a groundswell of national publicity for Reno. And I'm just so glad that Reno was selected as the host city for this spectacular sporting event.

Like bowling, Reno is a great American comeback story that deserves to be told. On the eve of June 27th, as the finals of Bowling's U.S. Women's Open will be played under the Reno Arch, two of America's great treasures will be brought together for an incredible sports viewing experience. Talk about a win-win.

Court rejects corporate campaign spending limits

(AP) ? The Supreme Court on Monday reaffirmed its 2-year-old decision allowing corporations to spend freely to influence elections. The justices struck down a Montana law limiting corporate campaign spending.

By a 5-4 vote, the court's conservative justices said the decision in the Citizens United case in 2010 applies to state campaign finance laws and guarantees corporate and labor union interests the right to spend freely to advocate for or against candidates for state and local offices.

The majority turned away pleas from the court's liberal justices to give a full hearing to the case because massive campaign spending since the January 2010 ruling has called into question some of its underpinnings.

The same five justices said in 2010 that corporations have a constitutional right to be heard in election campaigns. The decision paved the way for unlimited spending by corporations and labor unions in elections for Congress and the president, as long as the dollars are independent of the campaigns they are intended to help. The decision, grounded in the freedom of speech, appeared to apply equally to state contests.

But Montana aggressively defended its 1912 law against a challenge from corporations seeking to be free of spending limits, and the state Supreme Court sided with the state. The state court said a history of corruption showed the need for the limits, even as Justice Anthony Kennedy declared in his Citizens United opinion that independent expenditures by corporations "do not give rise to corruption or the appearance of corruption."

Twenty-two states and the District of Columbia, as well as Sen. John McCain and other congressional champions of stricter regulations on campaign money, joined with Montana.

Two liberal justices who were in dissent in Citizens United ? Ruth Bader Ginsburg and Stephen Breyer ? already had challenged Kennedy's view that the independent campaign spending could not be corrupting by virtue of the absence of links to a campaign.

When the court blocked the Montana ruling in February, Ginsburg issued a brief statement for herself and Breyer saying that campaign spending since the decision makes "it exceedingly difficult to maintain that independent expenditures by corporations 'do not give rise to corruption or the appearance of corruption.'"

Ginsburg appeared to be referring to the rise of unregulated super PACs that have injected millions of dollars into the presidential and other campaigns. She said the case "will give the court an opportunity to consider whether, in light of the huge sums currently deployed to buy candidates' allegiance, Citizens United should continue to hold sway."

The corporations that sued over the law said it could not remain on the books after the Citizens United decision.

Montana urged the high court to reject the appeal, or hold arguments and not issue what the court calls a summary reversal. The prevailing side in the lower court almost always strives to avoid high court review. But Montana and its supporters hoped a thorough debate over the Citizens United decision would lead to its reconsideration or at least limits on its reach.

The case is American Tradition Partnership v. Bullock, 11-1179.

Spain to seek bank aid as borrowing costs soar

LUXEMBOURG/MADRID (Reuters) - Independent auditors said Spanish banks may need up to 62 billion euros in extra capital, to be filled mostly by a euro zone bailout, after Spain's medium-term borrowing costs spiraled to a euro-era record on Thursday.

Euro zone finance ministers met in Luxembourg to discuss how to channel up to 100 billion euros ($126 billion) in aid to Spanish lenders weighed down by bad debts from a burst property bubble. Madrid's economy minister said a formal request would be made in days for the bailout, which was agreed two weeks ago.

Many in the markets see the package as a mere prelude to a full program for the Spanish state, which Madrid vehemently denies it will need.

Spain's financial plight took centre stage a week before a European Union summit tackles long-term plans for closer fiscal and banking union in a bid to strengthen the euro's foundations, after bailouts for Greece, Ireland and Portugal failed to end a 2-1/2-year old debt crisis.

To pave the way, the leaders of Germany, Italy, France and Spain will meet in Rome on Friday.

"We are clearly seeing additional tension and acute stress applying to both banks and sovereigns in the euro area," International Monetary Fund chief Christine Lagarde, who attended the Luxembourg meeting, told reporters.

"With that in mind, the IMF believes that a determined and forceful move towards complete European monetary union should be reaffirmed."

Two independent audits by consultants Roland Berger and Oliver Wyman found that Spanish banks would need between 51 and 62 billion euros in extra capital to weather a serious downturn in the economy and new losses on their books.

The Bank of Spain said the 100 billion euros offered to Madrid two weeks ago would give a wide margin of error. Spain's three biggest banks would not need extra capital even in a stressed scenario, it said. The government said it did not expect to shut any banks and would restructure those in trouble.

In Luxembourg, the finance ministers decided Spain should initially apply to the euro zone's temporary rescue fund, the European Financial Stability Facility, with the loan taken over by the permanent bailout fund the European Stability Mechanism (ESM) once it is up and running after July 9.

"The financial assistance will be provided by the EFSF until the ESM becomes available, and then it will be transferred to the ESM," Jean-Claude Juncker, who chairs the Eurogroup of finance ministers, told a news conference.

"We would expect the Spanish authorities to put forward a formal request for financial assistance by next Monday," he said.

Such a solution should avert a problem which had scared investors: debt issued by the ESM must be paid back first in case of a Spanish default, relegating private creditors lower in the pecking order. Because the new bailout debt will originate from the EFSF it will be issued without that requirement.

THREATENING YIELDS

Earlier on Thursday, Madrid sold 2.2 billion euros in medium-term bonds, drawing strong demand almost entirely from domestic banks. Yields on 5-year paper rose to a 15-year high of 6.07 percent, a level regarded by analysts as unaffordable for any prolonged period.

"They raised 2.2 billion versus a 2 billion target, so they can raise the money," said Achilleas Georgolopoulos, a strategist at Lloyds in London.

"Then the (question is), are the yields threatening for the medium term? And yes, clearly they are much higher than the previous auction ... But still they can continue for a few months to fund at these levels."

The finance ministers also signaled there may be some leeway for Greece, following the formation of a coalition of mainstream parties committed to the country's 130 billion euro EU/IMF bailout but determined to renegotiate some of its terms.

Athens will ask lenders for two more years to hit fiscal targets and an extension to unemployment benefits as it seeks to soften the punishing terms of the bailout that saved the country from bankruptcy.

Greece's euro zone partners, in particular paymaster Germany, have offered modifications but no radical re-write of the conditions attached to the lifeline agreed in March.

Juncker said nothing would be decided until the troika of EU, IMF and European Central Bankers had returned to Athens for a look at the books, starting on Monday.

"We will have a look into the findings of the troika and then we will discuss in detail the different means and instruments which can be used," he said. "It doesn't make sense for the time being to give more precise indications on the content of the program."

RESCUE FUND TO THE RESCUE?

The German government and opposition reached a deal that will allow parliament to approve the ESM next week, but Germany's top court may delay the rescue fund's start date, saying it needed time to study the treaty.

The ESM cannot come into effect without approval by Europe's biggest economy. Ratification also requires the signature of the president and a nod from the constitutional court in Karlsruhe.

The parliamentary floor leader of Chancellor Angela Merkel's conservatives appeared to dash French and southern European hopes of nudging Berlin towards common euro area debt issuance, saying there would be no mutualisation of debt in Europe.

Italy disclosed that it was missing its target to lower the budget deficit to 1.7 percent of gross domestic product and will have to cut spending by a further four billion euros to meet the goal.

Italian Prime Minister Mario Monti suggested, on the sidelines of this week's G20 summit, using the euro zone's rescue funds to buy the bonds of Spain and Italy in the secondary market to bring down their borrowing costs.

Monti hosts Spanish premier Mariano Rajoy, Germany's Merkel and French President Francois Hollande in Rome on Friday and is also expected to raise the idea there. Merkel has played down the proposal, which investors said might be counter-productive unless the ECB stepped in decisively in support.

Any European bond-buying would come with strings attached, equivalent to the sort of bailout programs that Rome and Madrid are trying to avoid because of the stigma attached.

Given the limited capacity of the temporary EFSF and planned permanent ESM rescue funds, with at most 500 billion euros available, a senior EU source said such intervention would make sense only if the ESM had a banking license enabling it to borrow from the ECB. Germany has so far opposed that idea.

Opinion: On Zizou, nostalgia and French mediocrity

DONETSK, Ukraine (AP) -By cruel irony, the day upon which France vaunted its footballing mediocrity by losing to Spain at Euro 2012 also happened to be the 40th birthday of Zinedine Zidane.

Ah, Zizou! Even six years after the retirement of the midfielder with the magical feet, it's impossible not to miss him when his successors look so unworthy, with less collective verve than the son of Algerian immigrants sometimes seemed to have in his big toe.

More than any other Frenchman, with the exception perhaps of Michel Platini, Zidane fed the illusion that France is a great football power.

Has that ever seemed further from the truth than now, after this European Championship where the French tied with a wounded England, lost to Sweden and beat only the tournament co-host, Ukraine?

Yes, at the last World Cup. That was when the entire French team humiliated itself and its nation by going on strike, sitting on a bus, curtains drawn, refusing to train. In a rare moment of lucidity, Raymond Domenech, their then-coach who no one now misses, slammed that group as "a bunch of irresponsible, stupid brats" who became "the laughing stock of the world."

So true.

A French optimist - are there any left? - would argue that the good news is that that was the nadir. Collectively punished and then put back piece by piece by Domenech's classy successor, Laurent Blanc, France does at least now have team.

Just not a very good one.

It is not a disgrace to lose 2-0 to the world and defending European champion. But in this eastern industrial outpost of European football, where the air had a slight chemical whiff in the Donbass Arena that overlooks mines and slag heaps, Blanc brought a team as dangerous as a popgun against a Spanish armada of stars from Barcelona and Real Madrid. While Italian referee Nicola Rizzoli ensured that this was a fair fight, it was never an equal one.

Blanc knew the Spanish would be hard to hurt because, in his words, they so rarely share the football. That clever choreographed selfishness is both a form of attack and defense for the Spanish, because opponents can't score against them without the ball.

So Blanc set up his team to defend and hoped to rush Spain's goal when rare opportunities presented themselves. The lack of ambition inherent in his plan paid a compliment to Spanish superiority and spoke of French inferiority. It also never really worked. Within 15 minutes, Blanc had fished out of his smart suit trousers the piece of plastic he nibbles to death during a game. Again, one couldn't help but think that Zidane and Blanc would never have displayed such temerity when they were winning the 1998 World Cup and Euro 2000 together.

"You have to be so efficient against Spain, with so little of the ball," Blanc said. "We tried to spring forward from the back but we weren't fast enough in getting that first pass out ... And they are also very good."

The Donetsk crowd, likely expecting a thrilling exhibition of "Ole!" football, instead entertained itself with chants of "Ukraine! Ukraine!" and Mexican waves. Boris Becker, who used to give tennis crowds a better show when he was winning Wimbledon, was displeased, tweeting that the game was "boring."

In fact, it's fascinating to see how Spain stifles opponents by starving them of the ball. When Jordi Alba delivered the cross that Xabi Alonso headed in for Spain's first goal, it seemed like he had all the time in the world. The Spanish so rarely seem harassed. And when they are, goalkeeper Iker Casillas is there with his safe hands, spooning away Yohan Cabaye's first-half free kick that was headed for the top right hand corner of the Spanish goal.

So the Frenchman who most recently scored a competitive goal against Spain remains Zidane, in extra time of a 3-1 victory at the 2006 World Cup. Patrick Vieira scored the second French goal that day before Zizou's. And Vieira, too, celebrated his 36th birthday on Saturday. Strange. It was as though football's gods wanted to make us nostalgic with these quirky coincidences.

But an even more telling statistic is that France's 2-0 defeat of Ukraine at Euro 2012 was the first time that the French had won a match in the finals of a European Championship without either Michel Platini or Zidane in the team.

Astounding. Another way to read that is that without those megastars and the successes their eras brought, we'd think of France as a middling football country with delusions of grandeur - a bit like England.

In rebuilding the national squad that devoured itself and the stock of goodwill that Zidane's generation had accrued, Blanc has done good work. At his first press conference as coach in 2010, Blanc said the hard core of players he felt he could lean on was no larger than "a melon's pip."

It's perhaps melon-sized now. Striker Karim Benzema is an undeniable talent, even though the Real Madrid star leaves Euro 2012 without having scored. His partnership with winger Franck Ribery will produce goals down the road. But the French defense is full of holes like gruyere cheese.

And France's old demons of 2010 - born, essentially, of footballers' over-inflated egos - still haven't been put completely to rest. At these Euros, Blanc was forced to douse heated arguments in the French dressing room after they lost to Sweden - a defeat that bumped France into Saturday's quarterfinal against Spain, instead of a hoped-for easier encounter with the less daunting Italians.

In short, on his birthday, Zidane was missed more than ever.
